So, What is Probate?

In England and Wales, Probate is the word used to describe the legal and financial processes involved with dealing with the property, money and possessions of a person who has passed away.

Before the executor of the Will can sort out any of the deceased’s assets, they may have to apply for Probate.

Who Can Apply For Probate?

If there is a Will, the person named as the executor of the Will should be the one to apply for a Grant of Probate.

If there is not an existing Will, a close adult relative can apply for a letter of administration, which will grant them the same rights an executor. They will then be known as the administrator of the estate. The estate will have to be settled according to intestacy law, rather than the wishes stated in the Will.

The probate process usually consists of:

  • Valuing the estate

  • Collating the deceased's bank accounts and insurance policies
  • Completing the Probate Application Form (PA1)
  • Even if the estate doesn't owe inheritance tax (IHT) an IHT205 form needs to be completed for the HMRC
  • Submitting all the applicable forms
  • Attending a probate meeting to sign a Letter of Truth, declaring that all the information you have provided is true to the best of your knowledge
  • Paying any taxes due
